KSL News Report on Mini’s Cupcakes vs. LuAnn’s Cupcakes

More on the cupcake lawsuit between Mini’s Cupcakes and LuAnn’s Cupcakes.

PARK CITY — A cupcake war is brewing in Utah. Mini’s Cupcakes was the first cupcake maker of its kind in Utah. Its signature cupcake is called the “Breakfast at Tiffany’s.” But Mini’s owner says LuAnn’s Cupcakes in Park City has copied her work with the “Tiffany’s Jewels” cupcakes.

Mini’s owner Leslie Fiet says, “She has several cupcakes that are completely different from my cupcakes, but this just happens to be our most popular and most distinctive cupcake that people associate with Mini’s.”

In a lawsuit, Mini’s claims that LuAnn’s has “adopted a strategy and philosophy to intentionally and unlawfully trade off the goodwill that Mini’s has built by infringing Mini’s trade dress rights in the Breakfast at Tiffany’s cupcake.

LuAnn Lukenbach who owns LuAnn’s says she doesn’t want to comment on the case.

I have had LuAnn’s Cupcakes and LOVE them, I can’t speak to Mini’s as I have never had them…but a chocolate chip cookie is a chocolate chip cookie, they all pretty much look the same and taste the same too. I don’t know if I think its worth anyone’s time to sue over the look of a cupcake that neither of them were the first to think up…I bet Mini’s wasn’t the first cupcake shop to think up the “blue” Tiffany themed cupcake.

  3. I absolutely agree with you both! I love baked goods and the customer will always go where the sweets & service is good and will completely be turned off by “drama” such as this. I read this blog and I am from the East coast loving and living in Salt Lake, but when it comes to sweets there is so much “copying” here it’s crazy! If you are a good baker and have great ideas good for you! If you are a good baker and you are “INSPIRED” give credit due to where you got the idea! Case example of the “blue fairy” shop…. not nagging on it’s success which is awesome, but it has taken full credit for “cakebites” or some cupcake recipes which I have seen, tried and purchased back East/West Coast for years! And then I remember reading an article on a local magazine and on these bites and giving her full credit for coming up with them! People, watch out….Utah is booming and expanding into a wonderful Urban Metro especially for culinary…if you recipe cheat…watch out!! You will get caught! Give credible references & claim originality on great past relatives recipes who can’t fully represent you and the recipe! :P

  4. I meant, give credible references …do not GIVE credit to past “relatives” who CANT fully represent you and the recipe! In case of Mini & Lu Anns…its too bad and like comment 1 & 2 …do any of them own or have permission to use the “Tiffany Trademark”?
